Default When should you have the green card

Following marriage to my gf who is a US citizen, my greencard application process is taking a really long time. Can someone please tell me when the latest date is for me to have the greencard and apply to all programs. Is it July of this year or September. Thanks for any help.

ppl apply with pending greencards. if you have work perit by july you can start residency.
if you are in US you dont have to have GC in hand.
but you write in you rstatus GC holder it will make big difference.
I know people who were pending like me ad wrote GC holder and got 20 IVS. i had my real status which was pending by then.

Thank you so much for the reply. Do you mean that I can apply on 2015 September while my greencard is pending and actually need the greencard and status change completed by JULY OF 2016??

Tamata,

I am pending GC status too but I did not receive my EAD card yet. If I get matched, do you think I can use my EAD card instead of GC? my EAD card will come in April.

please would you mind if I asked you a question? once you get your GC are you obliged to stay on US, I mean can you have your GC and stay living on your home country for a while ? thank you in advance

Yes your EAD is all that is needed to start residency

No, you are obliged to stay in the US UNTIL you get your green card (unless you apply for a travel advance parole), but once you have it you can come and go as you please.

having a us bf will not get you a green card, you need to be married. Typically you need to apply for a K1 visa to enter the US to get married (takes about 6-9 months at least), then once you are married apply for adjustment of status to green card holder, which takes another 6-9 months.

It is a long process and takes a lot of planning and paperwork, but all the info can be found easily online.

I know I need to be married.
We are still planning on that tho
I did not know about that K1 visa...

My fiance is a green card holder and we're going to get married soon. What happens if i apply for green card after marriage? The process for green card spouse takes 2-3 years. Does that mean i will have to apply under J1 category even though my green card application will be in process if i apply for 2016 match?

You will need to look into this. I dont know how long it takes if you start the process after you get married. As long as you can get your EAD before residency starts you wont need any other visa.

I very much hope it is not a problem and i can start my residency with Work authorization while pending GC. you dont even need work atuhorization to apply. you need it by starting date which is JULY of next 2016
your WOrk permit is all you need to function in US. GC is for travel. and of course its permanent. you are eligible to do same things ith work permit as y would do with GC. HOpe im getting matche tomorrow yay day is here

What ive found on the net doesnt seem very encouraging. Says you get the work permit very late. The processing time for green card for spouse is 2-3 years assuming ur marrying a GC holder not a citizen. The work permit may be available towards the end of that time period. I really dont know which category id apply for the 2016 match. J1 has the condition requiring u to go back to ur home country at the end of residency training. But then if they find out u have a green card application in process would they grant u the J1 visa?

You can apply for a H1 visa as well. If you get a J1 visa you can apply for a J1 waiver which requires you to work in an underseved area...

I guess the H1 visa is the best option. It requires step 3 though. Any idea how hard it is to get H1 visa? Also do u know if its possible to apply for another visa if ur green card application is in process? Or is it better not to apply for GC in this situation?

You have to apply for a visa as you can't get green card soon enough. The difficulty of getting H1 and =1 visas is all over this forum. It's better to apply for green card after you fiancée gets her citizenship.

Here is the thing guys
* It takes 2-3 years to get a green card after marrying a US citizen or permanent resident under family based immigrant visa category F2A. So there is no point in getting married, say today, and hoping to get a green for Sep 2015 Match.
* You are ineligible for a work permit if you have a family based immigrant visa application at the NVC pending approval. You can only work and travel to the US after your priority date becomes current and you get your green card. There is no way on earth to expedite this process, just wait in line for your turn. I remember reading about K1 visa holders- with K1 visa being granted to husbands of permanent residents, I presume, being able to get an EAD, but I'm not sure. Someone please correct me if I'm wrong about this point.

* Your J1 visa will probably get rejected if you apply with an immigrant visa application being processed. You have to cancel your green card then apply again after you get a two year J1 visa waiver
* You can apply for an H1 visa while having a green card processing and when you priority date becomes current you can adjust your status to green card. But as we all know not so many programs sponsor an H1 visa

Now will someone please answer my questions:

1) When you apply for the Match in Sep 2015, can you say you are a green card holder even though you still didn't get your green card yet because it is still being processed by the NVC
2) What is the latest date that a non US-IMG can apply for a J-1 visa to start residency on July 1. My understanding is that a J-1 visa takes a number of months to process.
