Medicolegal and Ethics Disclosing HIV status to employers or customers!

when a physician evaluates an employee as a part of medical evaluation required by an employer / insurance , does he have an obligation to report the patients hiv status to the employer?

I understand that if the employee signs a medical release form the physician can....but what if the employee says not to reveal the information.

Should the physician be obligated to the employee or employer?

Should an HIV positive physician/surgeon reveal his status to his patients even though he is taking sufficient protective measures?

pls some one explain

There's no legal obligation to disclose the HIV status to employers. However, the physician should try to convince the patient that it's better to tell the employer.

This is what Conrad Fischer taught @ Kaplan.

There is no obligation. If pt. do not want to disclose, doctors cannot disclose it. However, patient should be encouraged discussing this with employer.

This very concept will apply with wife or family member.

ok ,even if it the doctor was appointed to evaluate a person by the employer before giving him a job? does it hold good then also?

what abt my 2nd question? does a physician/surgeon need to reveal his hiv status to patients? pls reply thanks a lot

Physician dont need to reveal HIV status to patients.

and here is another example.
if colleague physican knows HIV status of a physician ,then also colleague physician should not reveal / report to anyone as long as Infected Physician is taking universal precautions.
