Medicolegal and Ethics HIV Ethics Case

You are evaluating a new patient that has come to your clinic for management of his HIV infection. He has high CD4 cells and a low viral load and does not require treatment . He is married and does not practice safe sex with his wife. His wife is unaware of her husband's HIV status.
What is your duty?
a. Encourage discussion bet the husband and wife and strongly suggest the disclose his HIV status with his wife
b. You must keep his HIV status entirely confidential at all times
c. Have the city Department of Health inform the wife
d. Send the wife a letter to come to your office because of an "urgent" health issue and then inform her
e. There is no need for partner notification as long as they are practicing safe sex

but isnt it MANDATORY to report a transferrable disease to the spouse if he/she is unaware...
and also to the authorities

it doesnt fall under the NO CONFIDENTIALITY thing.... so shudnt u tell the wife?????

i think it might be C

Its a mandatory reportable disease.
You call the dept. and disclose to them - it will be your duty, and their dutyis to take care of stuff...

Definitely C.

I am never sure about USMLE questions =)

But its not that much about ethics in here, but saving a life, that is the first priority

yes its mandatory to tell the wife , but the first step is always to encourage the pt to do it , or if the QS said that pt refuses to do it or has not paid heed to your advice then inform her ...

so would go would A ....

The correct answer is A (I just did this question yesterday)
Reason: The question mentioned "You are evaluating a new patient"- Which means you have not previously encouraged the pt to tell his wife about his HIV status. First you always have to tell encourage the pt to tell his partner about it. If he doesn't inform the parther then you report it to the Department of Health and have them inform the wife.

answer is a.
as the patient is having a single sexual partner A is first step in handling this case.
if patient does not then the health department is involved in informing partner but they to will not reveal the patients name to person at risk.
hiv is not mandatory reportable in all states
