Medicolegal and Ethics Commercial Interests

Dr. James is a cardiologist and researcher who, after years of hard work, creates a new, more flexible coronary artery stent that is easier to manipulate during cardiac catheterization. The initial response to this invention is so positive that he decides to take a business partner. He begins a small company that manufactures and sells these stents. Dr. James knows that the interventional cardiologists at Hospital X purchase and use his stents, while those at the hospital downtown, Hospital Y, do not use his stents. He also knows that outcomes at the two hospitals are similar, although no data have yet emerged about which stent is better.
What is the most appropriate way for Dr. James to approach cardiac catheterization for his private patients?
(A) Dr. James should not be involved in commercial interests as long as he is involved in patient care in the same medical field
(B) He may refer patients to either hospital and does not need to disclose his economic interests in Hospital X; the patients can ultimately decide to which hospital they want to go
(C) He may refer patients to either hospital but must inform them of his economic interests in Hospital X
(D) He should only refer patients to Hospital X so they may benefit from his superior technology
(E) He should only refer patients to Hospital Y so as not to take advantage of patients for his own economic benefit

Arrow Correct answer is C

Dr. James should disclose the information to his patients because he has conflict of interests (his patients interests versus his financial interests).

Answer A: is incorrect because he's allowed to do so as long as he discloses the financial interest.
Answers B, D, E: were to be correct answers if there was "solid evidence" that his stent is better for patients.
