The Family and Medical Leave Act, also known as FMLA, is an act under Californian federal law, which authorizes eligible employees under a covered employer to take unpaid and job protected medical leaves for specified medical reasons.

Similar rights, to take family care and medical leave, are also provided to an employee under the California Family Rights Act (CFRA). The rights under CFRA are more vivid and broader in most cases, when compared with rights under FMLA.

What if you are denied the right to take family care or medical leave?

It is fine not to know your rights under CFRA and FMLA well. But that doesn’t mean you can be denied leave. It is a prerogative and you deserve it.

If your employer is giving you a hard time and not permitting you to take family care or medical leave, that you think is well under the law, then you should seek assistance from an experienced California medical leave law attorney to understand your rights under either FMLA or CFRA.

A medical leave law attorney has the education and experience to represent you, or guide you about what you can do if you have been denied right to family care or medical leave under either FMLAorCFRA or both.
